Terms of Service

1. Agreement

By creating an account, starting a trial, or using Insta24 websites or applications, you agree to these Terms of Service, our Privacy Policy, and — when you store Instagram audience or CRM/shop/booking data — our Data Processing Addendum. If you use Insta24 on behalf of an organization, you represent that you have authority to bind that organization.

2. The service

Insta24 provides Instagram management, automation (comments, DMs, stories and related workflows), shared inbox, analytics, CRM, booking, shop (where offered), and related tools. Features depend on your plan and region (including billing providers such as Stripe or ZarinPal).

We may modify, suspend, or discontinue features with reasonable notice when practicable. Beta or experimental features may change or end without notice.

3. Accounts and eligibility

You must provide accurate registration information and keep credentials secure. You are responsible for activity under your workspace, including team members you invite. Notify us promptly of unauthorized access.

Age: You must be at least 16 (or the higher age required in your country) to create an Insta24 account. A checkbox at sign-up is a statement, not an identity check. You must comply with Meta Platform Terms, Instagram policies, and applicable law. Insta24 is not affiliated with Meta; Instagram is a trademark of Meta Platforms, Inc.

You are responsible for having rights and consents needed for messaging and automations you configure, including your audience (see the DPA).

4. Acceptable use

You agree not to:

• Spam, harass, or send unsolicited bulk messages in violation of Meta or local rules
• Scrape or collect data you are not authorized to access
• Circumvent rate limits, security, or billing controls
• Upload malware or attempt to disrupt the service
• Misrepresent affiliation with Insta24 or Meta
• Use the service for unlawful content or fraud, or to target children unlawfully

We may suspend or terminate accounts that violate these Terms or create risk for users or platforms.

5. Customer content and Instagram data

You retain rights to content you submit. You grant Insta24 a limited license to host, process, and transmit that content solely to provide the service.

Disconnecting an Instagram account stops new sync; it does not by itself erase stored conversations. Use Disconnect and delete or account deletion for erasure of Meta-sourced data we hold.

6. Plans, trials, and payment

Paid plans renew according to the checkout flow unless cancelled. Taxes may apply. Iran-market and global pricing may differ. EEA/UK/CH workspaces use Stripe, not ZarinPal. Refunds, if any, follow the policy stated at purchase or required by law. Failed payments may lead to suspension.

After account deletion we may retain anonymized billing records as described in the Privacy Policy.

7. Intellectual property

Insta24, its software, branding, and documentation are owned by Insta24 or its licensors. These Terms do not transfer ownership. You may not reverse engineer except where prohibited restrictions are unenforceable by law.

8. Third-party services

The service integrates with Meta, payment processors, hosting, auth, and monitoring providers listed on Subprocessors. Their terms apply to their services. We are not responsible for outages or policy changes by third parties that affect connected features.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted Instagram API access or specific business results.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTA24 WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE/DATA. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.

11. Indemnity

You will defend and indemnify Insta24 against claims arising from your content, automations, misuse of the service, or violation of these Terms or third-party rights, except to the extent caused by our willful misconduct.

12. Suspension and termination

You may stop using the service and request account closure in Settings. We may suspend or terminate for breach, legal risk, non-payment, or extended inactivity. Provisions that by nature should survive (IP, liability, indemnity, billing hold) survive termination.

Deleting an owned workspace removes that tenant’s product data for all members of that workspace.

13. Governing law

Unless mandatory local consumer law says otherwise, these Terms are governed by the laws applicable to Insta24’s principal place of business (placeholder — counsel to name the entity and venue), without conflict-of-law rules. Courts in that venue have exclusive jurisdiction, subject to consumer rights that cannot be waived.

14. Changes

We may update these Terms and the terms version. Continued use after the effective date constitutes acceptance where permitted; for material changes affecting registered users we may require re-acceptance in the product.
